It should be an indicator that your "court" is a sham when the defendant tries to confess and the judge has no idea how to respond. Personally I don't think we should give them the death penalty because of the whole martyr aspect. Not the part about them getting virgins in heaven and all of that shit, but the part where they can seen as having been killed by the "great satan" by those sympathetic to their cause.
These guys need to go to a real court, and then probably to a real prison for a real long time. If they decide to execute them I won't complain too loudly. I've always said that I have no real issue with killing killers, I just don't trust our legal system to be perfect. And this whole idea of having to set up a whole new court system in order to try these people is just fucking stupid, unless of course you don't care about the law and just want to be able to get the convictions you want without having to admit to torture or show evidence or follow the constitution or the genevea convention or.... oh wait. Now it makes sense.
I really really hope that Bush,Cheney, Rumsfeld et. all are tried for war crimes in the near future. Especially Rummy, he deserves to rot in jail for the rest of his life, but even he deserves a trial. Ok maybe lock him up for a decade or so before that trial but a trial none the less.

How far have we fallen
First off this post I'm going to link to is a bit foul even by the standards of the rude pundit, don't worry its just words but damn that dudes a bit deranged, unfortunately he has a point. The basic point is that one of the saddest legacies of this administration is an idealistic one, its the fact that horrible atrocities no longer have the ability to shock us. We now debate the role of torture around the dinner table, can we give a person a label which in essence strips them of their very humanity by saying they no longer have any legal rights at all? What sort of a country have we become when the military admits that it has been delivering propaganda straight to your living room and no one is the least bit concerned? I know I wasn't surprised when I heard it. I should have been furious I should have stuffing rags into gasoline filled wine bottles and marching on the pentagon, but I didn't I shrugged my shoulders and said yup, that seems like something they would do. What has become of us?
Oh right the economy, shit I can't even afford the gas to fill a molotov cocktail these days.

Gitmo for the Whole Family
Capture a 15 year old Canadian kid fighting in Afghanistan, keep him locked up for the next 6 years, try him as an enemy combatant instead of the juvenile he is. I can see why they hate our freedoms....
I'd have more to say, but really what can be said? It's news reports like this that make me ponder the downfall of western society, and wonder if its happening fast enough.

I love this Man
If I were gay I'd be begging scientists to figure out a way to make little Rude-Trout bastard children because this man writes like no one else. I'm of course talking about the Rude Pundit. One of several blogs that I check up on every day. His latest one covers the latest court rulings, the FCC case and the Gitmo cases. While I talked about these briefly yesterday I wasn't able to come up with words that conveyed the true sense of what was going on, The Rude Pundit found those words. And defines the exact difference between a person thats being an asshole vs being a dick, it's really quite informative.

Gitmo Cases Thrown Out
Well the good news is that "enemy combatants" do have rights under the geneva convention. But if they are "unlawful enemy combatants" then they do not. So far the courts have said that the detainees are only "enemy combatants" and therefore cannot be tried in the newly created court. Of course they are appealing this but the court they are appealing to doesn't even exist yet. So at the end of the day the good news is that the prisoners may eventually get a fair(ish) trial, the bad news is it won't be anytime soon and until then they'll stay locked up in gitmo, so nothing really changed at all.
